Rosetta Canyon Conflicts of Interest - Cr...

<p><strong>Rosetta Canyon HOA Board President Mr. Adam Armit is Senior Client Executive of Park West Landscaping and causes a huge conflict of interest being that he is is employed by&nbsp;Park West Landscaping. Park West Landscaping was awarded the Contract voted on by the five (5) board members behind closed doors and not disclosed to the homeowners.</strong></p><p>We have also noticed that&nbsp;there has been excessive planting of new plants only to tear them out and plant with something else within the next month while the HOA is passing out landscaping&nbsp;violations like candy (which is easy to do when their yards are being cared for free by <strong>Park West Landscaping</strong>), and they are not violating themselves.&nbsp;The fact that the contract to <strong>Park West Landscaping</strong> is in excess of $300,000.00 and is the largest&nbsp;expense of our HOA budget at approx 31% of all dues paid by the Homeowners of Rosetta Canyon.</p><p>When the&nbsp;board members took office they all had to sign a declaration stating the there were no conflicts of interest or even the illusion of a conflict of interest that was prepared by the Law Firm <strong>Fiore Racobs & Powers</strong> who was hired by <strong>Avalon</strong>&nbsp;management.</p><p>99.99% of Rosetta Canyon homeowners do not know of this conflict of interest, but all 5 Board members surely do as they are the 5 board members who awarded the contract, so therefore we&nbsp;are formally Petitioning for the removal of all 5 and are named as follows below:</p><p><em>We wonder why Mr Armit didn't use his official work email address on the official documents posted on our association website...&nbsp;</em></p><p>President Adam Armit<br />Email:&nbsp;<a href="mailto:Adam.Armit@Verizon.net">Adam.Armit@Verizon.net</a></p><p>Vice President Linda Cooley<br />Email:&nbsp;<a href="mailto:Lcooley12@Verizon.net">Lcooley12@Verizon.net</a><br /><br />Treasurer Luis Padilla<br />Email:&nbsp;<a href="mailto:LaPad78@Gmail.com">LaPad78@Gmail.com</a><br /><br />Secretary Paul Suter<br />Email:&nbsp;<a href="mailto:Paul.Suter@Verizon.net">Paul.Suter@Verizon.net<br /><br /></a>Director Franchiska Garrett<br />Email:&nbsp;&nbsp;<a href="mailto:Paul.Suter@Verizon.net">Board4@MyRosettaCanyon.com</a></p><p>We as homeowners in Rosetta Canyon did receive the&nbsp;newsletter stating that the HOA Board has recently negotiated a new contract with Park West Landscaping, we are all sure negotiating with yourself goes very well<strong>.&nbsp; </strong></p><p><strong>This is a very serious conflict of interest as Park West Landscaping was awarded the contract.&nbsp;This issue can become grounds for Criminal action under Penal Code 503 PC Embezzlement and Penal Code 487 PC Grand Theft.</strong></p><p><strong>Below is a clip from Avalon Management's&nbsp;website regarding Conflicts of Interest.</strong></p><p><strong><em>Conflict of Interest</em></strong></p><p><strong><em> Directors must avoid any conflicts of interest with The Community. A "conflict of interest" occurs when a Director's private interest interferes in any way with the interests of the community as a whole. In addition to avoiding conflicts of interest, Directors should also avoid even the appearance of a conflict. This Code does not attempt to describe all possible conflicts of interest that could develop. Some of the more common conflicts that Directors must resolve or avoid, however, are set out below: &bull; A conflict situation can arise when a Director, a member of his or her family, or a close personal friend takes actions or has interests that may make it difficult for the Director to make decisions on behalf of The Community objectively and effectively</em></strong></p><p>&nbsp;</p><p>We are also&nbsp;requesting to have <strong>Park West Landscaping</strong> contract terminated immediately and request&nbsp;bids from other landscaping companies that all homeowners can review.. let's make this fair neighbors and take back control of our neighborhood.</p><p>Since Rosetta Canyon currently has a total of&nbsp;1012 Lots and the rules state we need 20% of homeowners to sign the petition that would mean we as homeowners only need 205 signatures to remove them from the board.</p><p>Once our&nbsp;community finds out about this I'm sure it will not take any more than 1 weekend to get the required amount of signatures starting this weekend.</p><p><strong>Please join with us and Vote them all out and elect a board that we can trust.</strong></p><p><strong>Sign the petition if you feel there is violation of trust or a conflict of interest.</strong></p>
